Grand Jury To Consider Case Against PA Hunter

The Lewis County Grand Jury could consider charges against a Pennsylvania hunter, accused of killing a West Virginia hunter in April, as soon as next month.

Lewis County Prosecuting Attorney Gary Morris tells MetroNews, as of now, he anticipates pursuing a case against 58-year old Robert Tobias of Millersburg, Pennsylvania on charges of involuntary manslaughter and wanton endangerment.

That could change, though.  "We haven't determined that yet," Morris said on Monday.

Tobias has reportedly confessed to firing the shot that killed 31-year old Shawn Stewart of Walkersville.  It was a fatal blast to Stewart's head that happened on the first day of spring gobbler season.  Stewart had been hunting with friends in the Vandalia Bay Area of the Stonewall Jackson Wildlife Management Area.

State Police used an article of hunting clothing found near the scene to track down Tobias as their lead suspect.

Involuntary manslaughter is a misdemeanor charge.

"First degree (murder), second degree (murder) and voluntary manslaughter require intent to kill on the part of the actor," Morris explained.  You could infer from that definition that investigators believe the shooting of Stewart was an accident.

Morris, though, says they're not ruling out anything at this point.  "We just continue to work on it."

The next session of the Lewis County Grand Jury meets on July 13th.
